Article 2 – Scope of Application
These General Terms and Conditions of Sale govern sales made on the Devaux Fly Fishing website between MOUCHES DEVAUX CHAMPAGNOLE and any individual acting for purposes outside the scope of their professional activity.
The site is exclusively intended for B2C sales.
No delivery is offered in France.
Orders are open to consumers whose delivery address is located:

in one of the member states of the European Union, excluding France; or

in the United Kingdom.
Any order implies unreserved acceptance of these GTC.
Article 3 – Products
The products offered for sale are those presented on the site at the time of the order, subject to availability.
MOUCHES DEVAUX CHAMPAGNOLE endeavors to present the essential characteristics of the products as accurately as possible.
Product photographs and representations are for illustrative purposes only. Slight differences in color or rendering due to factors such as the screens used do not necessarily constitute a lack of conformity.
In the event of a product being unavailable after the order has been validated, the Customer will be informed as soon as possible, and any amounts collected for the unavailable product will be refunded.
Article 4 – Price
The applicable prices are those displayed at the time of order validation.
Prices are displayed in the currency offered for the Customer's country and include all taxes when the corresponding taxes are collected by MOUCHES DEVAAUX CHAMPAGNOLE.
Delivery costs may vary depending on, among other things:

The total amount payable will be communicated to the Customer before final order validation.
MOUCHES DEVAUX CHAMPAGNOLE reserves the right to modify its prices at any time. Modifications do not apply to orders already validated.
Article 5 – Taxes and Duties Applicable to the United Kingdom
Orders destined for the United Kingdom may be subject to customs formalities as well as import taxes, duties, or customs clearance fees.
When these amounts are not collected at the time of the order, they remain the responsibility of the Customer and may be claimed upon import or delivery.
MOUCHES DEVAUX CHAMPAGNOLE cannot be held responsible for the amount of duties, taxes, or fees that may be claimed from the Customer by the relevant authorities or intermediaries.
Article 6 – Order
The Customer selects the products they wish to purchase and adds them to their cart.
Before final validation, they can check:

their delivery address;

delivery costs; and

the total amount of their order.
They can correct any errors before definitively validating their order.
An order confirmation is then sent to the Customer electronically.
MOUCHES DEVAUX CHAMPAGNOLE reserves the right to refuse or cancel an order, particularly in the event of suspected fraud, payment incident, or obvious error concerning the price or characteristics of a product.
Article 7 – Cancellation before Shipment
The Customer may request cancellation of their order as long as it has not yet been shipped or handed over to the carrier.

Article 8 – Payment
Payment is made online at the time of order.
Payment methods that may be offered include:
Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay, and PayPal.
The actual available methods are those displayed at the time of the order.
Payments are processed via secure providers used by the store.
MOUCHES DEVAUX CHAMPAGNOLE does not receive the Customer's complete bank details when these are processed directly by the payment provider.
Article 9 – Delivery
Products are delivered to the address indicated by the Customer when placing the order.
The proposed delivery methods depend on factors such as the destination and the products ordered.
Delivery costs are communicated before final order validation.
Orders are normally shipped within 48 hours, excluding weekends, public holidays, and exceptional circumstances.
This period corresponds to the preparation and handover time to the carrier. It does not constitute a commitment on the total delivery time.
When a delivery time is indicated at the time of the order, this constitutes the estimated applicable time.
Article 10 – Receipt of Products
The Customer is invited to check the condition of the package and products upon receipt.

Article 11 – Statutory Right of Withdrawal
The consumer Customer has a statutory period of 14 days from receipt of the goods to exercise their right of withdrawal, without having to justify their decision.
When several goods from the same order are delivered separately, the period runs from the receipt of the last good.
The Customer must inform MOUCHES DEVAUX CHAMPAGNOLE of their decision to withdraw before the deadline expires.

Article 12 – Return under the Right of Withdrawal
After notifying their intention to withdraw, the Customer must return the product(s) concerned to the following address:

Direct return costs remain the responsibility of the Customer.
Under the statutory right of withdrawal, the Customer may handle the product to the extent necessary to establish its nature, characteristics, and proper functioning.
Their liability may be engaged in the event of depreciation resulting from handling beyond what is necessary for this verification.
Article 13 – 30-Day Commercial Return Policy
Independently of the statutory 14-day right of withdrawal, MOUCHES DEVAUX CHAMPAGNOLE grants the Customer an extended return option of up to 30 days after receipt of the order.
Beyond the statutory right of withdrawal period, products returned under this commercial policy must be:

in their original packaging.

Article 14 – Refund
In the event of withdrawal exercised in accordance with the legal provisions, the refund will be made within the deadlines imposed by the applicable regulations.
Under the 30-day commercial return policy, the refund will normally be made within 7 days after receipt and inspection of the returned product.
The refund will be made, unless impossible, by the same payment method used for the order.
Article 15 – Legal Guarantees
The products sold benefit from applicable legal guarantees, including:

the legal guarantee of conformity; and

the guarantee against hidden defects.
The legal guarantee of conformity applies under the conditions provided by the Consumer Code.
For goods, the consumer notably benefits from a two-year period from the delivery of the product to assert this guarantee.
The guarantee against hidden defects applies under the conditions provided by the Civil Code.
MOUCHES DEVAUX CHAMPAGNOLE does not offer any additional commercial guarantee, unless expressly stated otherwise for a particular product.
Article 16 – Liability
MOUCHES DEVAUX CHAMPAGNOLE is responsible for the proper execution of its contractual obligations in accordance with applicable legal provisions.
Its liability cannot be engaged when non-execution results notably from:

an act attributable to the Customer;

a force majeure event; or
-
an unforeseeable and insurmountable act of a third party to the contract.
No provision of these GTC shall have the effect of depriving the consumer of a mandatory right granted to them by law.
Article 17 – Personal Data
Personal data collected as part of the website's operation and orders may be used for:

payment;

delivery;

returns management;

customer relations; and

compliance with legal and accounting obligations.

Article 18 – Intellectual Property
Content on the Devaux Fly Fishing website, including brands, logos, photographs, texts, illustrations, graphics, and visual elements, may be protected by applicable intellectual property rights.

The mediator is seized according to the conditions and procedures provided by the FEVAD.
This recourse is free for the consumer, provided that the admissibility conditions for mediation are met.
Article 20 – Applicable Law and Disputes
These GTC are subject to French law.
However, when a Customer resides in another State, this provision cannot have the effect of depriving them of the imperative protections they benefit from under the law applicable in their country of residence.
In case of dispute, the parties are invited to seek an amicable solution first.
Failing an amicable agreement or mediation, the dispute may be submitted to the competent courts in accordance with the rules applicable to contracts concluded with consumers.
